The Hungarian government announced Tuesday that parliament has voted to end the extraordinary legal order conferring special powers on government during the coronavirus pandemic.<\/strong><\/p>\n

Belying panicked reports<\/a> that Hungary was trying to establish a \u201cdictatorship,\u201d the government will end<\/a> its self-imposed state of emergency peacefully as early as Wednesday at midnight.<\/strong><\/p>\n

<\/p>\n

Gergely Guly\u00e1s, chief of staff of Prime Minister Viktor Orb\u00e1n, said<\/a>\u00a0the government welcomes parliament\u2019s decision to approve the termination of the state of emergency.<\/p>\n

\u201cThe rules of the Hungarian constitution are clear. The government in this situation had special powers to pass laws, but this is now over,\u201d Mr. Guly\u00e1s said.<\/p>\n

\u201cWe\u2019ve got through the first wave [of the epidemic]. We don\u2019t know if there\u2019ll be a second one, but the operative board will remain active and the provisions passed into law will remain in place,\u201d he said.<\/p>\n

<\/figure>\n

While thanking whose who contributed to the coronavirus response efforts, Guly\u00e1s censured \u201cthe left\u201d for its failure to come together with the nation to address the crisis.<\/p>\n

Guly\u00e1s also announced an upcoming nationwide \u201cnational consultation\u201d survey to give Hungarians the chance to express their opinions on the government\u2019s response to the epidemic.<\/p>\n

While the European Commission acknowledged<\/a>\u00a0there was no basis for a case against the government of Prime Minister Viktor Orb\u00e1n for violations of the rights of the Hungarian people, this did not prevent leftists from declaring Hungary a \u201cdictatorship.\u201d<\/p>\n

The foreign ministers of Denmark, Finland, Iceland, Norway, and Sweden all signed<\/a> a letter slamming Hungary\u2019s Wuhan coronavirus response, leading Hungarian Foreign Minister P\u00e9ter Szijj\u00e1rt\u00f3 to chastise his counterparts for \u201cspreading false news.\u201d<\/p>\n

\u201cWe are moving on, but let us make one thing clear now: Hungarians are a nation more than a thousand years old, and it does not ask for this pathetically hypocritical patronising,\u201d he said.<\/p>\n

Hungary\u2019s ambassador to the Holy See, Eduard Habsburg, noted<\/a> in a tweet Wednesday: \u201cSo just in case you missed it yesterday \u2013 extraordinary \u2018Corona powers ended by, yes, the Hungarian Parliament. (As announced beforehand).\u201d<\/p>\n

\u201cNo dictatorship. Just democracy at work, folks,\u201d he said.<\/p>\n

<\/figure>\n

While similar measures were accepted as necessary in other EU member states, Hungary was singled out for criticism for taking steps taken elsewhere without criticism. Some, in fact, went further than Hungary and have yet to relinquish the special powers they assumed.<\/p>\n

Without ever declaring it, for example, Italy\u2019s unelected government assumed similar \u201cspecial powers,\u201d imposing a series of restrictions on the rights of citizens and businesses that were never approved by the Italian parliament.<\/p>\n

Legal scholars have accused<\/a> the Italian government of serial violations of the national constitution by assuming powers that do not belong to it.<\/p>\n

<\/figure>\n

Writing<\/a> in\u00a0Milano Finanza<\/em>, Italian law professor Maria Lucia Di Bitonto said in late April that Italy\u2019s ongoing national lockdown to stem the spread of the coronavirus constituted a serious abuse of authority and an effective suspension of the rule of law.<\/p>\n

Most of the constraints on individual freedoms and on production activities aimed at dealing with the pandemic \u201cfind their legal justification in decisions of the executive or of regional or peripheral institutions,\u201d Prof. Di Bitonto\u00a0declared.<\/p>\n

The absence of parliamentary approval represented a serious legal and political breach, she stated, since \u201cthe only source empowered to limit freedoms is the law, a direct emanation of popular sovereignty.\u201d<\/p>\n

\u201cThe political importance of the many legal reservations established by the Constitution regarding freedom is crucial,\u201d Di Bitonto said, because \u201cthey ensure that the only source authorized to alter people\u2019s lives is that which is a direct expression of the sovereignty of the same individuals against whom the restrictions are intended.\u201d<\/p>\n
